This Limited Warranty applies to the Cygnus 360 Hard Hat (Model 360H) sold by Cygnus Safety Products, LLC (“Cygnus,” “we,” “us,” or “our”). Please read it together with the product’s User Manual, which contains important inspection, care, and replacement instructions.
WHAT THIS WARRANTY COVERS
Cygnus warrants that the Cygnus 360 Hard Hat (Model 360H) will be free from defects in materials and workmanship under normal use and service for twelve (12) months from the date of original retail purchase, when used and maintained in accordance with the product’s User Manual and applicable ANSI/ISEA Z89.1-2014 requirements. This limited warranty extends only to the original purchaser and is non-transferable.
BATTERIES, CHARGER, AND CONSUMABLES
The rechargeable 18650 lithium-ion cells, USB charger, and other consumable components are warranted against defects in materials and workmanship for ninety (90) days from the date of original purchase. Gradual loss of battery capacity or runtime over time is normal for lithium-ion batteries and is not a defect covered by this warranty.
WHAT THIS WARRANTY DOES NOT COVER
This warranty does not cover:
- Normal wear and tear, scratches, scuffs, fading, or cosmetic damage that does not affect function.
- Any helmet subjected to an impact, whether or not damage is visible. A hard hat absorbs impact by partial destruction of the shell and suspension; a helmet that has sustained a significant impact has performed its function, must be removed from service and replaced, and is not eligible for warranty replacement.
- Damage from misuse, abuse, accident, neglect, or use outside the product’s intended purpose or certified rating.
- Damage from improper storage, including heat or UV exposure (for example, leaving the helmet in a vehicle or in direct sunlight), which degrades the shell over time.
- Damage from unauthorized modification, alteration, disassembly, or repair, or from use of non-approved parts, accessories, or attachments.
- Water or dust ingress beyond the product’s IP53 rating, or exposure to chemicals, solvents, paints, or adhesives.
- Battery depletion or aging, or damage caused by using an incompatible charger.
- Products with a removed, altered, or illegible serial number, or products purchased from an unauthorized reseller.
NOT A GUARANTEE OF PROTECTION OR SERVICE LIFE
This warranty covers manufacturing defects only. It is not a warranty of the helmet’s protective performance and does not extend the product’s safe service life. Regardless of warranty status, the helmet must be inspected before each use, replaced immediately after any impact, and retired in accordance with the User Manual. We recommend replacing the shell no later than five (5) years from the date of manufacture and the suspension at least every twelve (12) months, or sooner if wear is present.
WHAT CYGNUS WILL DO
If a covered defect is found during the applicable warranty period, Cygnus will, at its option and as your sole and exclusive remedy, repair the product, replace it with the same or a comparable product, or refund the original purchase price. Replacement products or parts may be new or reconditioned and are warranted for the remainder of the original warranty period.
HOW TO MAKE A CLAIM
Contact Cygnus at info@cygnussafetyproducts.com with (1) your name and contact information, (2) proof of purchase showing the date and place of purchase, (3) a description of the issue, and (4) photographs where applicable. Do not return any product without first receiving return authorization. The purchaser is responsible for shipping the product to Cygnus; if a covered defect is confirmed, Cygnus will cover the cost of returning the repaired or replacement product.
DISCLAIMERS AND LIMITATION OF LIABILITY
To the fullest extent permitted by law, this limited warranty is the only express warranty Cygnus makes for the product and is given in place of all other warranties. Any implied warranties, including implied warranties of merchantability and fitness for a particular purpose, are limited in duration to the term of this warranty. Cygnus shall not be liable for any incidental, consequential, special, or indirect damages arising from the use of or inability to use the product, including personal injury, property damage, or lost profits, except where such limitation is prohibited by law. Some states or jurisdictions do not allow limitations on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. This warranty gives you specific legal rights, and you may also have other rights that vary by state or jurisdiction.
WHOLESALE AND FLEET ORDERS
Products purchased through distributors, dealers, or national or fleet accounts may be covered under separate terms set out in the applicable order or agreement.
